Real Estate Litigation / Mortgage Banking Attorney - Position Overview:

We are seeking an attorney to join our lending and real property litigation practice. Experience in consumer finance, mortgage banking, and real property litigation is preferred; however, we are also open to training attorneys with civil litigation experience who have a strong interest in developing expertise in these practice areas. This position offers the opportunity to work on sophisticated real estate, mortgage banking, foreclosure, title, and lender liability matters in a collaborative and flexible work environment.

Key Responsibilities:

• Handle all aspects of real estate and consumer finance litigation, including discovery, motion practice, depositions, mediations, and trial preparation
• Defend lenders and financial institutions in lender liability actions involving TILA, RESPA, FDCPA, FCRA, wrongful foreclosure, and related claims
• Manage lien priority, title, fraud, forgery, undue influence, and other real property disputes
• Prosecute judicial foreclosure actions and address impediments to non-judicial foreclosure proceedings
• Represent lenders in loan repurchase, indemnity, and secondary market disputes
• Pursue loan fraud recovery and recoupment actions against borrowers, brokers, appraisers, and other real estate professionals
• Draft pleadings, motions, briefs, and other litigation-related documents
• Handle bankruptcy-related litigation, including relief from stay proceedings and adversary actions

Qualifications:

• Experience in civil litigation, real estate experience preferred but not required
• Exceptional writing, research, and analytical skills
• Ability to manage multiple complex matters independently
• Mortgage banking, title insurance, regulatory compliance, and licensing experience is a plus
• Strong client communication and case management skills
• J.D. from an accredited law school preferred
• Licensed in California and in good standing
